Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, products, tools, and services offered by ResilientNiche, a brand operated by 30 Andover Holdings LLC (“ResilientNiche,” “we,” “us,” or “our”), including the website at resilientniche.com, the digital products we sell (such as The AI Citation Playbook and related upsells), and the free tools we make available (such as the AI Visibility Check and the AI Visibility Tracker) (collectively, the “Services”). By accessing or using the Services, or by purchasing any product, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase or use the Services. By using the Services, you represent that you meet this requirement and that you have the authority to enter into these Terms.

2. Products & Services

ResilientNiche offers a range of products and services that may include, at various prices and tiers: digital courses and written materials, video lessons, templates, prompts, tool recommendations, access to a member community, personalized diagnostic reports, strategic plans, and group or one-on-one coaching. The AI Citation Playbook is our flagship digital product. The exact contents of any product may evolve over time at our discretion, but the core deliverables described on the sales page at the time of your purchase will be made available to you.

Access is delivered electronically. After your payment is processed you will receive an email with instructions to access the materials. If you do not receive access within a reasonable time, contact us at malik@resilientniche.com.

3. Free Tools & AI-Generated Analysis

We offer free tools (including the AI Visibility Check and the AI Visibility Tracker) that analyze a website you submit and return an automated report. By using these tools, you agree that:

• You own the website you submit, or you have permission to request an analysis of it. Do not submit URLs you have no right to analyze.
• To produce a report, we fetch and read publicly available pages from the submitted website and send extracted content to third-party AI providers (such as Anthropic and Perplexity) for analysis. See our Privacy Policy for how this data is handled.
• The reports are generated in part by AI and are provided for informational purposes only. They may contain errors, omissions, or out-of-date information, and they are not professional, legal, financial, or marketing advice.
• You will not abuse, overload, scrape, reverse-engineer, or attempt to circumvent any usage limits, authentication, or rate limits on the tools, and you will not use them to analyze content in a way that is unlawful or that infringes the rights of others.

We may impose usage limits, require an account, charge for additional usage, or discontinue any free tool at any time without notice.

4. Accounts

Some Services require you to sign in (for example, the AI Visibility Tracker requires an account, using email and a password or Google sign-in). You are responsible for maintaining the security of your account and the email inbox associated with it, and for all activity that occurs under your account. Do not share access to your account with others. Notify us promptly if you believe your account has been accessed without your authorization.

5. Pricing & Payment

Prices are listed in U.S. dollars and shown at checkout. The current price of The AI Citation Playbook is a one-time fee of $27; other products, upsells, coaching, and usage-based credits are priced separately and shown before you purchase. We may change pricing at any time, but the price you see at checkout is the price you will be charged for that order. Applicable taxes may be added based on your location.

Payment is processed by third-party payment processors (including our checkout provider and Stripe). By submitting a payment, you authorize us and our processors to charge your selected payment method for the amount shown. Where the Services use prepaid credits or usage-based billing, the applicable terms and balances are shown in the tool.

6. Refunds & Subscription Billing

Digital products (The AI Citation Playbook and related one-time products). We offer a 60-day money-back guarantee on The AI Citation Playbook. If you have honestly worked through the materials and applied the system, and the results are not what we promised, email malik@resilientniche.com within 60 days of your purchase. Describe what you tried, and we will issue a full refund. Requests submitted after the 60-day window, or requests where no attempt to use the materials has been made, may be denied.

AI Visibility Tracker subscription. The AI Visibility Tracker is sold as a recurring subscription, billed either monthly or annually depending on the plan you select at checkout. Your subscription will automatically renew at the end of each billing cycle, and your payment method on file will be charged the then-current price for your plan, until you cancel.

Free trials. Some plans may be offered with a free trial that requires a payment method at signup. If you do not cancel before the trial period ends, your subscription begins automatically and your payment method on file is charged the plan price shown at checkout. You may cancel at any time during the trial from the Billing section of your account and you will not be charged. We send a reminder before the trial ends, but it remains your responsibility to cancel in time. Charges made after a trial converts are subject to the non-refundability terms below. Free trials are limited to one per customer, and we may withhold or revoke trial access where we detect abuse (for example, repeat trials under different accounts).

You may cancel at any time from the Billing section of your account, or by emailing malik@resilientniche.com. When you cancel, your subscription remains active and you keep full access through the end of the billing cycle you have already paid for; it does not renew after that. To avoid being charged for the next cycle, submit your cancellation before your next billing date.

Except where required by law, subscription fees are non-refundable and we do not provide refunds or credits for partial billing periods, unused time, or unused credits after a billing cycle has begun. Monthly plans are not eligible for a refund. For annual plans paid upfront, a refund may be considered only if it is requested within 30 days of the original purchase or renewal date; contact us at the email above.

Credit top-ups. One-time credit purchases are consumed as you use the tools and are non-refundable once purchased. If a payment for a renewal fails, access to your plan's allowances may pause until payment is resolved, and we may retry the charge or adjust your billing terms. Refund terms for coaching and any other products or services are as described at the point of purchase.

7. License to Use the Materials

When you purchase the Services, we grant you a personal, non-transferable, non-exclusive, revocable license to access and use the materials for your own business, learning, and implementation.

You may not:

• Resell, redistribute, sublicense, or share the materials with anyone else, including by sharing your account credentials.
• Reproduce, repackage, or republish the materials, in whole or in part, in any course, paid newsletter, agency offering, or other commercial product.
• Use the materials to train, fine-tune, or otherwise improve any machine-learning or AI model.
• Use the materials in any way that is unlawful, infringing, or harmful to third parties.

We reserve the right to revoke access and pursue any available legal remedies if you violate this license.

8. Intellectual Property

All content in the Services (including text, videos, prompts, templates, graphics, code, software, the diagnostic rubric and reports, and the underlying methodology) is owned by ResilientNiche or its licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership of any of that content to you. The report we generate about your own website is provided to you for your use, but the rubric, scoring system, and analysis methodology behind it remain our intellectual property.

9. Community Conduct

Access to any member community is a privilege, not a right. We may remove or restrict any member who:

• Posts harassing, hateful, or threatening content.
• Spams the community or promotes unrelated offers without consent.
• Shares paid materials, member credentials, or proprietary content with people who have not purchased the Services.
• Otherwise violates these Terms.

10. No Guarantee of Results

The Services provide a methodology, templates, automated analysis, and our experience. They do not guarantee any specific outcome, traffic level, revenue, ranking, or AI citation result for your business. The examples, numbers, and case studies on the sales page describe our actual results and the results of others; they are not promises of what you will achieve. Outcomes depend on many factors, including your niche, execution, time invested, and forces outside of anyone's control (such as search-engine algorithms and AI vendor policies).

11. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any AI-generated report is accurate, complete, or current.

We do not warrant that the Services will be uninterrupted, error-free, or that any defects will be corrected.

12. Limitation of Liability

To the maximum extent permitted by law, ResilientNiche and its owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to the Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or related to these Terms or the Services will not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless ResilientNiche and its owners, employees, and affiliates from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of your use of the Services, your submission of any website or content for analysis, your violation of these Terms, or your violation of any third-party right.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms. On termination, your license to use the materials ends. Provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive termination.

15. Changes to the Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.

16. Governing Law & Disputes

These Terms are governed by the laws of the State of New York and applicable U.S. federal law, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Services will be resolved in the state or federal courts located in New York, and you consent to personal jurisdiction there.
